On 10th December 2007 the Court of Appeal passed judgment in the case of R v Sean Hoey who was convicted of the Omagh bombings. The appeal focussed on the reliance of the prosecution on Low Copy Number (LCN) DNA evidence. The judges, in quashing the convictions, were particularly scathing about the use of LCN DNA evidence, and the Criminal Cases Review Commission are now considering inviting applications from any persons convicted on the basis of such evidence.
Carter Moore has recently learned of its appointment to the elite Very High Cost Case (VHCC) Panel of the Legal Services Commission (LSC). The VHCC Panel comes into force on 14th January 2008. As from that date only firms who have been appointed to the panel, having been approved by the LSC as having the requisite competence and experience in handling serious and complex cases, will be allowed to represent defendants in cases deemed to fit the criteria of a 'Very High Cost Case' in publicly funded matters.
